yeah he got screwed but mostly b/c if he did get a lawyer, the lawyer was full of shit. and if he didn't, he needed to because his claim should be appealable to the superior court and up (i've read CA cases where small claims were appealed to the ca supreme court). plus wtf? denying a viable defense under the anti-slapp law is pretty ridiculous. i dunno. there is something very sketchy about the legal matters.

i am curious: have any of you people bashing kaplan and the court taken any initiative to hear kaplan's side of the story?

as much as i hate yaman salahi in particular and the sjp in general, i would actively take up their side on this matter. that is, if the judgement indeed, in some reasonable sense of the word, quashed free speech on their part, as salahi claims it did. however, looking through some of the details from kaplan's side, i'm not impressed with salahi's claim to freedom of speech.

take a look at, e.g., pages 6-9 or so of the motion filed on 05/25/07 by kaplan (per salahi, the awful alameda county courts web interface has it linked from http://apps.alameda.courts.ca.gov/domainweb/casesumbody.html under case number BS06288332; go to "register of actions" from there)

no, i haven't seen all the motions, and all the evidence, etc. but i'm not in charge of adjudicating the case, either. but it sure doesn't sound like salahi is the clear-cut victim he makes himself out to be.

(anonymous because i frankly don't want to get involved in the potential flamewar. the trial documents are public, and i'd rather people judge for themselves, and start the flamewar if they are so inclined.)

Lee Kaplan is lying to you.


I would consider that as a form of speech protected under 1st amendment.

Ha ha , the above comparisons are supposed ( set – up) to be contradictory -- so by making the last one similar, you are saying Kaplan is a truth teller.

Of course, he will not.

Freedom of speech is an idea, a concept, an ideology, not a law where one can say or do anything. Libel laws have been around for a while. One cannot make things up about someone in order to financially ruin them – something that was accused toward salahi.


That is why he doesn’t want to go into details.

There are more than two sides of the story and the court got both sides, not in this spam post – a sympathetic cry post.
