subject [Fwd: critical mass july 08 incident important!!!]
mailed-by karrot.org

There was an incident on 7/25/08 during Critical Mass ride at 15th and Aloha.

3-4 bikers were blocking off a car so the rest of the riders can continue, they were telling the driver that he needs to wait couple of minutes. Driver was inpatient, and kept telling things like "I have a reservation, I have to go" There was more bikes blocking him off because of the argument, at some point the driver got very mad, and turned around going on the side walk, almost hitting some bikes. Then the bikers started getting closer to the car so he wouldnt drive in the middle of the riders, and the argument got heated. Bikers were telling him to wait, and all of a sudden the driver said something like "Fuck this" and drove into the bikers. He intentionally hit people, injuring 2 bikers, and smashing couple of bikes, and back packs. He started driving away while everyone was running away from him so they wouldnt get hit as well.

Some bikers ran after the car, while others call 911. By the time police showed up, 2 of the car windows were broken and his tires were slashed. When the driver saw the police, he started crying and saying he was just scared, but none of the bikers even touched him before he ran over people.

I heard someone saying "The tires were slashed so he couldnt drive off"

2 of the bikers got arrested for property damage, and they are booked to jail. THEY HAVE COURT TODAY STARTING AT 12.30 PM AT KING COUNTY COURT HOUSE, COURT ROOM #1. So we need people who saw what happened to contact us, because the driver is trying to pull off that he didnt do anything.

Channel 5 tried to interview us, but we refused to talk with them, and it seems like media is showing the incident like "Violent bikers attacked a car..."

Bikers who got hit by the maniac driver, and bikers who got arrested need support from the community. Please contact via e-mail ekirgoz@yahoo.com, if you were witness or if you could show any kind of support, and share ideas...

I will post updates on this case but in the mean time please remember there is a court today !!!

edit: one of the biker's account, and the cops blame the bikes : http://seattlepi.nwsource.com/local/372364_criticalmass27.html

While I absolutely do not condone the driver, I have to say, I do not like Critical Mass and their tactics. I certainly do not condone their actions post-incident, either. That's mob rule. With the number of witnesses, they could have taken the license plate, called the police, and had the driver arrested. The bikers who slashed his tires and broke his windows deserve to be arrested just as much as the driver does, though obviously for different charges.

I agree completely. I think Critical Mass does a lot more harm than good.

Srsly. It's just like the traffic circle incident where both parties were acting immaturely and petty. It's a shame when people get injured or killed because they can't chill out.

I'm glad to hear some kind of official response from critical mass. Still, in my mind, there are 2 sides of the story and I'd like to hear the driver's story.

Like the traffic circle incident, my position is still that both parties were acting petty and immature. I don't think the bikers should have acted as traffic enforcement, trying to keep the driver from leaving. The driver wasn't being very understanding either because had the bikers not asked him nicely to wait for a moment so they could get by safely and he should have thought about others and acted like a bigger person.

Looks like the driver missed more than his reservations lol.

Hopefully between this incident and the traffic circle incident, we can all be reminded to use our words, our manners and just chill the fuck out. No one's time is worth getting injured or killed.

There are three sides to this story: the bikers' the driver's and the truth.

I hope we eventually get the truth. I doubt either side is telling it right now.

That said, one must wonder at why this happened in the first place - perhaps because the bikers are, in no uncertain terms, inciting it? "Critical Mass" is an event designed to create inconvenience, at best. But not for the event, this likely would not have happened. While the driver should be held accountable for his actions, so should the bikers.

I hope the media attention helps get the whole story out.

From my days in Chicago critical mass, I really doubt the media will get the whole story out. The important thing will be how the courts rule on it. The media won't publish a story where the cyclists are in the win since they already made a pretty anti-cyclist story.

And additionally, the only thing that's going to happen this afternoon is they're getting their first appearance, and arraigned (and the prosecutor has 72 hrs, iirc, to charge them). They'll get their next court date, if they plead not guilty, and it will be over and done w/.

BTW, security in the KCJ is naturally tight, so don't expect if you're going to have purses or any metal go through without a huge hassle.

Two wrongs are not about to suddenly start making a right.

It's easy to dismiss that one driver as a self absorbed hit-and run jackass.
It's even easier to dismiss the whole of critical mass as a pack of vigilante self-absorbed jackasses, who are mostly entitled white kids who can afford to be needlessly disobedient and lack the maturity to behave in a socially acceptable manner while doing so.

Whatever cause Critical Mass stood for in this city (except being a drunk hooligan), is totally tarnished by self righteous bullshit like this. Good Game.

I agree. I always wonder what would happen if someone had an TRUE emergency and were stopped by all those bikes. I had my injured dog in the car once and was trying to get to the er vet when a couple of bike riders decided to block my turn. They were breaking the law by riding their bikes in a ped crossing, the red hand was up and solid. I was turning right. I saw they had stopped but they decided to go even though I had the right of way (I had a green turn signal). Only after one of them, while circling my car, realised I had a severely bleeding dog did they let me go while shouting "I hope you learned your lesson, bitch."

So, no 2 wrongs don't make a right.

I admire critical mass for their objectives, but their means do not meet the ends.

I have a huge problem with cyclists in Seattle simultaneously wanting to be treated with the respect of other vehicles on the road, yet while not obeying the traffic laws themselves.

...if you want to sit at the table with the adults, you need to act like one.

Wait, why did the bikes think they had the authority to block another vehicle on the road in the first place?

Because they don't, no more than drivers of cars would have the authority to block bikers from using the road.

So, the bikers were in the wrong from the start.

"By the time police showed up, 2 of the car windows were broken and his tires were slashed."
"I heard someone saying "The tires were slashed so he couldnt drive off"

Annnnnd the windows were broken, to prevent him from driving off as well?

The act of intentionally slashing tires is a tad difficult when a car is moving. Which would indicate that the car was STOPPED when the tires were slashed. Which kind of blows the whole "to prevent him from driving off" angle all to hell. And, as a couple other people mentioned, why exactly was GETTING HIS LICENSE PLATE NUMBER an option?

"he started crying and saying he was just scared, but none of the bikers even touched him before he ran over people."

Let's look at what Muir Kumph's own run down of the events are:

3-4 people on bikes illegally block a car and tell him he needs to wait.

MORE bikes come to block him off because he says he has to go. So the driver is now seeing a mob gathering in front of his car.

He then TRIES TO GET AROUND THEM, by going up on the side walk. (I'm curious why he didn't reverse and go around that way...was there a car behind him that prevented that?). When trying to go around them, the bikers do not get out of his way, rather they GET CLOSER.

So now we have a guy in a car, having a growing mob blocking him and getting closer. Gee, I can't imagine why he got scared and perhaps was fearing for his life. Especially as we have no idea what was being said to him in this "heated argument."

Do I think he should have driven into the bikers? Honestly, I don't know at this point. Based on what Muir Kumph has written here, it's entirely possible that the driver was in fear of his life and, after making one attempt to leave by a non-direct route, and with the bikers advancing on him, he felt he had no options left.

This whole thing is unbelievably stupid and totally avoidable. I love riding bikes and I love using them as transportation, and when I first heard of Critical Mass, I assumed I'd be all for it. Then I saw what they were doing and was appalled, as I have NEVER seen an organization consistently take action that ends up in results so perfectly opposite their goal. They want to have drivers treat them as equals, share the road, raise awareness? Breaking the traffic laws and intimidating drivers, not the way to do it.

Critical Mass is starting to get a rep for violence, this same sort of thing has happened several times in SF now. Yes, there are a lot of asshole drives, but smashing in their windows is not an appropriate response.

I was there when CM weny by and it's clear that there are elements in CM that are actively seeking out confrontation with drivers.

Critical Mass, sa I understand it, is supposed to be a passive law-breaking act designed to create change in inequal laws. cf. lunch counter sit-ins.

The moment ANYONE associated with Critical Mass reacted to people trying to avoid in whatever way the CM riders' obvious, intentional illegal act, they fucked everything up.

Congratulate those cyclists for us all for fucking up everything you've worked for.

By not also calling for the proper court outcome for those cyclists who commited criminal acts, you are, necessarily, accepting those actions as a viable method of action.

ATTENTION CYCLISTS: CRITICAL MASS WANTS YOU TO VANDALIZE VEHICLES AND PHYSCIALLY HARM DRIVERS.

It should be in your press release. Let's face it. Earth First! and Sea Shepherd would have the balls to own up to this kind of aggression. CM would rather publicly ignore it happens while promoting these same actions behind the scenes.

You want to ignore the criminal actions of the CM bicyclists? You can't. You either accept and promote them, or you call them out and eject them.

I think that the bikers completely had the right to block the driver. It only makes sense when you have a "critical mass."
Blocking the car was for the drivers own, and others safety. What the driver did, from explanation above is considered road rage. Turning around, yelling, arguments, all of it is road rage. Because the bikers were on a form of transportation, that means that they are included in the road rage. But it wouldn't had to have gone there if the driver of the vehicle could be a decent human being for just a few minutes.

If it were a funeral procession where there was a line of cars 3 miles long, the driver would have had to wait. Just because bikes are an easier target, or inferior in his mind, that doesn't give him the right to power on through.

So it is ok for cyclists to break the law and cause chaos?
What if the driver had an emergency situation? I think it was aggressive behaviour on both sides started by the cyclists breaking the law.

Irrelevant, you are relating 2 separate rides together with no common goals or ideals. Critical Mass is not organized, it is not a group, it isn't anything. It is a periodic event perhaps, but nothing more.

If she testifies, that's gonna hurt, that word 'reservations'.

I don't care what you fatass dumbshits think you'd do. It wouldn't be much of a conscious choice. When you ride enough as a grown-up, you realize some people will use their cars as weapons. What do you do when attacked with a baseball bat? Cornered by a drawn gun? You cower or you resist. Fuck your politics, and fuck your pretty judgement.

it seems to me that most CM folks and their supporters take a very... interesting view on property damage.

namely that
a) damage to their own property is the height of crime

and

b) their damage to other's property is reasonable and not criminal

so they did $1000+ damage to some guys car because they didnt want him to escape. they were taking the law in to their own hands.

ultimately it seems likely that both sides were culpable here, but i suspect the CM side more so since it seems there was more intent on that side.

Sharing the road works both ways. It would be awesome if Critical Mass developed some sense of courtesy so that they represented bicyclers better to the rest of Seattle, and then maybe the PD wouldn't hassle us anymore.

Also, if you made me late for work by telling me I couldn't cross the road or something, I'd be right pissed too. There are stoplights for a reason. There are traffic laws for a reason. There are incentives to obey those laws, such as not getting hit by cars, and not pissing other people off.

Don't come here with your skewed sense of right and wrong and tell us to take your side. Grow up and grow some ethics, the whole lot of you.

More boo hoo needed from the cyclists.

We broke the law, we were banging on this guy's car. He got scared and decided to try to leave the area. Then we decided to break out his windows, slash his tires, and punch him in the face!

Its all his fault!!!!

A decent and moral human being would not run people over with their car. Period. It IS a deadly weapon and has been prosecuted as such in the past.

Riding bikes like assholes...I don't think this behavior warrants them being run over. I would have waited if it were me. It just isn't worth it. A few minutes of my time is not worth potentially taking someone's life or livelihood.

(Reply to this) (Thread)

[info]faerieburst
2008-07-27 02:58 am UTC (link)
It wasn't riding bikes like assholes that got them run over.

It was:
1. unlawfully detaining him
2. THEN preventing him from leaving the scene using an alternate route (even the cyclists admit he tried to leave at least one other way, other witnesses say two)
3. THEN gathering more and more people in a mob surrounding his car
4. THEN moving in closer and closer
5. WHILE having a "heated argument" (lord knows what was said and if threats were made)
6. THEN (by some third party accounts) getting ON his car

That's what got them hit.

A decent and moral human being would damn well run people over with his/her car if he/she was in fear for his/her life. Your blanket statement is fascinating to me. You made no exceptions there. You just said "would not" --- "Period." So, if it were you, walking to your car, some guy jumps out with a gun and says he's going to rape you, you manage to struggle free, and get inside your car, he is standing in front of your car, raises the gun and points it at you, and your choices are 1. get shot or 2. press the gas, you just sit there in get shot?

Not saying this scenario is the same as what happened on Aloha, just trying to point out the folly of blanket statements.

There are many, many scenarios in which a "decent and moral human being" would do such a thing. So much so that *even our legal system* acknowledges this. That's WHY there is a self-defense option available.
