Book by (fake) male prostitute-author (who is really a woman) called a fraud by jurors.

NEW YORK - To writer Laura Albert, her alter ego was a psychological necessity, but to jurors, the fictitious male prostitute JT LeRoy was a fraud. A Manhattan jury decided Friday that Albert had defrauded a production company that bought the movie rights to an autobiographical novel marketed as being based on LeRoy's life.


The federal jury, after a short deliberation, awarded $116,500 to Antidote International Films Inc.

The San Francisco author, who went to strange lengths to hide her identity behind the nonexistent LeRoy, condemned the jury's decision, saying it had ominous implications for artists.

"This goes beyond me," Albert said. "Say an artist wants to use a pseudonym for political reasons, for performance art. This is a new, dangerous brave new world we are in."

Antidote's attorney, Gregory Curtner, said the producers "have sympathy" for Albert.

"I think we would have preferred that we never had to get here," Curtner said after the verdict.

Albert was identified as the author of "Sarah," the tale of a truck stop hooker. Her friends donned wigs and posed as LeRoy at book signings and they duped journalists with the phony back story about truck stop sex. Posing as the troubled teen, Albert even made phone calls to a psychiatrist.

Antidote and its president, Jeffrey Levy-Hinte, said they spent $110,000 working on a film based on "Sarah." The company, which still holds a one-year option on the book, has no plans to use the rights now, but "they might be valuable to somebody else," Curtner said.

The jury ordered the $110,000 paid to Antidote, along with $6,500 in punitive damages. U.S. District Court Judge Jed Rakoff said he would determine later whether attorneys' fees would be awarded.

Although Albert stared straight ahead when the verdict was read, and said she expected the decision, she was quick to condemn it. She said that Antidote had succeeded in exposing more of her life story during trial and would try to make more money off of it.

"They made my life public domain. It's about commerce," she said. "They're going to try to hijack my copyrights, which is like stealing my child."

In bizarre testimony punctuated by tears and laughter, Albert told jurors during the trial that she had been assuming male identities for decades as a coping mechanism for psychological problems brought on by her sexual abuse as a child.

To her, she said, LeRoy was real.


But Curtner said Albert stepped over a line by signing contracts and obtaining copyrights under the phony name.

Albert's attorney, Eric Weinstein, said his client was disappointed by the verdict.

"We had a very smart judge and a very smart jury, and we can't change the outcome," he said.

I kind of feel for her female friends who posed as JT Leroy. "Yeah, you could pass for a man."

I even met both of them at the Toronto film fest - that is, the author and the person they got to pretend to be JT LeRoy before all this happened.

I guess, it's because they would feel a middle-aged woman would have less credibility talking about male child prostitutes. I'm definitely not condoning her actions, because I felt like it was quite low for her to adopt this personality, when people who went through the shit in her book probably looked to this JT LeRoy character as some sort of hero.

I believe you're thinking of the writer Dennis Cooper. Cooper was allegedly "friends" with JT LeRoy and wrote on similar topics.

That's not her, it's one of her friends who she got to dress up as JT. From what I've read, JT was supposed to be quite androgynous and of fairly fluid gender identity anyway.

Pen names, yes, of course. But she was pretending to be a whole different person. She claimed to be a young MtF transexual who had a past of incestuous sex abuse and prostitution. She would disguise her voice when talking to people. She had other people dress up as 'JT'. 'JT' wrote lyrics for her band. I mean, it just goes on and on.

And the books? ...kinda suck. Overrated, for sure.

Even though I didn't love the books, I still feel cheated. Glad she got what she deserved.

Oh, and 'ominous implications for artists' my ass. More like 'ominous implications for people who want to scam others out of money, mental illness or no'.

how did she exploit anything? she wrote a piece of fiction due to her own child abuse. regardless the entertainment / literature industry is not a non profit org. get over it. there are thousands of books, movies, songs, you name it about the same subject.

This sucks. I loved Sarah and The heart is deceitful above all things. But I started to wonder about the credibility (sp?) in the first book so I'm not surprised to be honest.

I don't see what's the big deal. The books were always marketed as fiction; so even if she led the public on, legally she's in no wrong doing. And I'm sorry, but I'll always love "The Heart is Deceitful Above All Things."

Well the way I see it is this: it's like if you signed a lease on an apartment, only to walk in and find it didn't have a roof. You might have seen a roof when you first looked, and the contract you signed said you had a roof, but there ain't no roof there now.

So legally, they've proven in court that they've incurred a loss thanks to the author's fraud. Or something. I am not a lawyer, but I reckon they must have signed something explicitly stating that this was a true story.

she does make an excellent point about the can of worms this opened up as far as the literary pseudonym world goes.
while she should have used third party corporate names on contracts so this never happened i think there is nothing at all wrong with using a fake persona. all artists do it to an extent. this company was just pissy because they knew a movie wouldnt do that well after the heart...
