Neighbour Problems and Tenant Rights

Hey Montreal,

I live in an apartment building which is poorly constructed - the floor and walls are thin, and you can hear everything your neighbour is doing. This has never bothered me as I realize that it is not the neighbour's fault. They are not being loud, the building just sucks.

Recently my next door neighbour and neighbour beneath me joined forces and complained to the landlord (without coming to me first) about my noise. They specified that the noise is not loud music, television, or parties...they can just hear me walking and talking at night. And they want it to stop.

My landlord went so far as to threaten eviction if I do not keep the noise down. I've started wearing slippers and trying to talk softer, but short of not moving or speaking there is not much else I can do. Can I really be evicted if my normal footsteps do not stop after 10 PM, the beginning of quiet hours? I am living normally and not making excessive noise. I just stay up late naturally and sometimes move around past 10 PM.

I have read this link, but it talks more about excessive noise than normal living noise:

Any help or advice would be greatly appreciated.

Where to call about a noise complaint

Hey guys,

I've been googling from my phone and now on the computer and I just can't seem to find the info. I live in the village (Ville-Marie) and my downstairs neighbors are having another loud party. Most of the time I just go out or do other things until it dies down, but this time (like a few other times) I have to get up early tomorrow. 4am, to be exact. I've spoken to them about this in the past and they apologized, but here we are again, after midnight, and the music is going strong, as is the loud chatter (in the apt, in the stairwell and - bonus - outside on their patio, which is right near my patio door in my room.) I can't seem to find the regular non-911 number that I'd need to call in order to someone over here and ask them to quiet down.

Any and all help would be appreciated.

Signed,

-Wishing I could just get to sleep.

NDG NOISE COMPLAINTS

Hi Montreal,

I searched the tags but I didn't find what I was looking for. My neighbors were out on their balcony at 11 p.m.  on Thursday being quite loud. My bedroom window is right there and I was just wanting to go to bed. I just started a new job and with the learning curve need all the rest I can get. So I asked them to be quieter, even if they are out there. They were rude and continued to be loud and were in and out on  the balcony until 1 a.m.
So, if this happens again, what can I do? Do I call the police or is there some sort of NDG service that you can call? Calling  the police seems a bit extreme but on the other hand, I really need to sleep on week nights and these rude teenagers don't care about anyone around them (I've had problems with them before).

EDIT: Thanks to all those who responded.

Does anyone know anything about Fire Regulations in Quebec? My crazy drunken neighbour is using our shared fire escape as a personal smokers balcony, laundry rack and garden. I'm not talking about the usual Montreal balcony with a spiral staircase, this is standard apartment building fire escape, no more than two feet wide with a ladder between floors. The fire escape is completely blocked by lawn chairs, potted plants and a bicycle. She's also using the apartment building hallway as an extension of her apartment, storing furniture, books, and recently, a dozen bags of garbage in it.

The landlord has already talked to her about the noise (screaming matches on the fire escape with her boyfriend when she locks him out of the apartment) but I was wondering if I could just call the fire department on her?

Noisy neighbor

I just moved into my new flat. Everything's great except my downstairs neighbor! They are super noisy all the time! Some times they would play music til 3 or 4 in the morning!!!!! I'm typing this post while being tortured by the bloody strong bass!!!!! I'm wondering if it's kosher for me to go tell them turn the music down during the day. I don't wanna be bi!chy about it, but the 'boom boom boom' is really getting on my last nerve!!!!! Even my floor's shaking!!!!!!

Update on my crazy neighbour

Many of you may remember me posting a little while back about my nutjob of a neighbour (the one who was complaining about my shower etc). Well today she finally pushed me past my limit and I called the police to file a report. However, it's been an hour and a half since I called, and while I realize this is nowhere near an emergency situation, I'm kind of wondering if they've forgotten about me! I also have to leave to go out soon (well in an hour) so I'm wondering if they're going to come at all. Should I call and see or just wait? I just want this to be over and dealt with already!
EDIT: I called again and was told that because there were several emergency calls ahead of me the cops would likely not be coming for awhile. I told them to cancel the call for tonight and the next time it happens I'll call again. Aaaargh. :(

At what time is it ok to call the police regarding noise?
For the past 3 hours, the tenants across the street has been using power tools to remodel the inside of the appartment. Normally I wouldn't mind. But it began at 8pm, and it's now well past 11pm, and they have the windows wide open and it keeps waking up my 2 year old.

I'm just curious. I won't call now, but if this continues, I will have no choice.
Isn't there a law stating no noise like this after 11pm?

Bank Seizing Apartment building...bad time to move in?

A friend of mine lives in an apartment building that I want to move into but it just got seized by the bank because the owner was behind on the payments. My friend told me that in terms of the people living there, nothing should change except for who owns it. I'm wondering if it's a bad time for me to consider moving in there, what I should find out and if any of you have been in this situation, what happened? Thanks in advance.

Is there anything I can do to get the people living upstairs from me to stop playing thier music so loud at 9am with the bass way up? It freaks the shit out of my old, diabetic cat. She's shaking and really upset. I don't know these people at all but I want the yowling of the kitty to stop. She doesn't deserve this. :(
