LJ and SUP
We've licensed SUP, a Russian internet company, the right to use the LiveJournal brand. They'll be operating portions of the LiveJournal service for our Russian userbase (and only for those that want this support). This partnership is an effort to improve the speed, usability, and services that are offered to our Russian community. The only changes that Russian users will see is an improvement to user experience, translation, and support.

The Russian users that have agreed to this support will still continue to be a part of LiveJournal, for as long as they want to be. SUP will be able to promote other products or services they develop to the Russian community, but they won't be able to disconnect anyone from LiveJournal or break apart the community. LiveJournal will still be in control of your journals. We're partnering with SUP to offer a better experience, since we know we've been strongly limited by not being able to serve our Russian community in their native language.


Here are a few of the common questions we know you have:

* What criteria will be used to determine whether a journal is "Russian" or not?
It will be a combination of if you write primarily in Cyrillic, have listed your location as a country from the former USSR, or use a Russian browser.


* Will there be a way to opt out of having my journal transfered?
No journals are being transferred; it's just a change in how the site will be supported.  You will be able to opt out of getting the new Russian features, and to continue to be supported by LiveJournal/Six Apart).


* Will information from these journals be given to the Russian government? Personal information?
No. Not in any way that would not happen today, such as a court-ordered subpoena. SUP is acting as our agent and will be bound by our Privacy Policy


* Will they have access to Russian users' private account information?
Again, only under our privacy policy, and bound by the same terms.


* Is SUP under any legal obligation to keep users' information confidential?
Yes, they are. They don't own any information, and they can't reuse it in any way not covered by our policies.


* Will SUP have access to non-Russian users' account information?
No. They have no involvement at all with other users on LiveJournal.


* Will they be handling payments for Russian users?
Yes, eventually SUP will be supporting this, which will allow us to make the payment process far less painful for users in the Russian Federation.


* Is SUP bound to maintain LJ's Terms of Service, or will they have the ability to create their own? What about the privacy policy?
The Terms of Service and privacy policy will not change without our express approval. We don't expect any changes, except to cover new services SUP will be able to offer, such as Russian SMS, etc.

Not for a several weeks. They will provide you with a page to opt out. Nothing happens or is transferred until you agree to it.

More specific information here would be appreciated. "private account information" is too vague.

The LJ privacy policy doesn't discuss the potential ability of LJ staff to monitor users' condidential (private/friends-only) entries, and makes no promises regarding such ability. Assuming that LJ staff are able, under some conditions and with appropriate safeguards, to monitor such data, is SUP going to be given the same ability for Russian users? If yes, under which conditions and will such access on the part of SUP be monitored by LJ staff?

I assume the russian-based staff may get access to private content. While being more or less comfortable with american-based staff's access rights, I absolutely would not want such access by Russian-based company (for jurisdictional AND cultural reasons).

Webplanet's Russian site sees this as a way to make a lot of money selling "contextual advertising", presumably ads that will appear in Russian LJers' journals:

Nossik makes Sup from the blogosphere

This year the viral term "blog" has become actively incorporated in the minds of people with surplus cash. And this is the result: co-founder of Ingosstrakh insurance company, Corbina Telecom and the Bookberry bookshop network Alexander Mamut, along with the creator of the Afisha.ru portal Andrew Paulson, plan to launch Russia's "largest blog portal" Sup. The investment into the project could comprise tens of millions of dollars, while it will generate income from contextual advertising. A company called Sup-Fabrik has been created to realise the project, and former Rambler President Anton Nossik has been invited to become one of the directors.

The Vedomosti newspaper reports on rumours of Sup-Fabrik's pending deals: negotiations on the purchase of the Russian part of LiveJournal.com and its Russian equivalent Liveinternet.ru, talks with AOL, Google, News Corp and others. Sup representatives for now refute any talk of deals, but they do not deny that they are actively recruiting programmers and well-known players from the .ru zone into the project. A 500 sqm office has been rented in central Moscow, in the Smolensky Passage, where rates are $700-800 per 1 sqm a year. We only have to wait for the next virus-terminology, such as "social networks", to penetrate the minds of the people with money.

I'm no lawyer, but the "laws of the State of California, U.S.A" currently govern the LJ TOS. Will journals that opt into SUP still be covered by Californian law, or by Russian law?

...and how would that affect that hypothetical court-ordered subpoena?

The laws of the US and California didn't stop the US cgovernment so there's no reason to expect them to stop SUP or the Russian government from using this new source of intelligence about activities in the former Soviet Union states and vulnerable individuals to target for recruitment or exploitation.

Seems like quite a betrayal of those who wanted to get away from Russian dominance.

This has probably already been answered, but is this an opt-in or opt-out service? I left the USSR with my family for a reason (several reasons, really... just thought I'd mention it because i'm pedantic), and being well aware of the level of access and extent of jurisdiction enjoyed by the Russian governmen, I'm certainly reluctant to have my details in a place where the can be reached by those people.

Just would like to undersign this statement. I left Russia in a hope never ever hear about possibility of discloser of my private information and my private life to the goverment just for the sake of getting better control over citizens.

It should be clear to anyone in the West that NONE of the companies can operate in Russia without possibility of providing transparent access to any of the company data to the goverment structures, namely infamous FSB.

I hope you will recall license from them. Just for start - AWFUL translation in [info]news. And those guys with 13yo translators want to do something for improving russian-language services?!

How much should I pay you so that you kick them out of LiveJournal?

P.S. Your TOS, Privacy Policy and so on mean NOTHING for them. They WILL use all and any information they will have access to at their own discretion.

I find it's really ridiculous and unaccpetable. Such a change, which going to happen to the TOS without any option to avoid it and will expose my private information to the set of people I have completely no trust and more over, who known to be dishonest(ok, I can't say for the whole group, but presence of [info]dolboeb as CBO of the SUP company says for itself). I find that Privacy Policy doesn't garanty privacy of my personal information in the case it'll be available to the SUP. Moreover, I suspect that mentioning exact number of russian speaking users already means that (part) of such information was provided to the SUP and despite talks of possibility of "opt out" they already have it.

I'm really disappointed by such a thoughtless decission made by 6Apart and also it brings up the question about trustiness of LJ in general - if anyone, who'll sign partnership agreement with 6Apart gets access to the users private information - how privacy can be garantied at all?!

Yes, if it'll be proven that SUP got my private information without my permission - it'll be definitely the last time I use LJ services.

It's very remarkable that one of the chief persons in SUP has a nickname that in translation means "dickhead" - the whole agreement seems to be under the influence of this magic word.

Прошу прощения за вмешательство - однако, сколько помню ЖЖ, информация о количестве пользователей из различных стран всегда находилась в свободном доступе в разделе "Статистика". :) Составляется, очевидно, на основе того, что пользователи указывают в своих профилях.

Впрочем, мне более интересно, какого рода частная информация может храниться в ЖЖ, если вы за нее так боитесь. 8) Еще за данные кредитки я могла бы побояться (кстати, именно поэтому никогда не подпишусь на систему автоматических платежей)... но что еще настолько ценное может здесь храниться? 8)

I am much more worried about where my money will go. I doubt, that I would wish to continue paying for my account, if my money are going to fund those SUP services. I have no problems with them accessing my private information, but not my money, however small amount that may be.

What is your definition of "Russian users"? I am a U.S. citizen and have lived in the U.S. for the last 17 years, more than half of my life, but I blog mostly in Russian. I don't want any Russian Federation - based company have any access to my account information.

Actually, you are one of that blessed persons who may help rest of the russian-speaking community to create a lawsuite against 6Apart in the case of discloser of private information to the 3d parities (SUP). Unfortunately, only US cort can make a decission on such a case and most of the russian-speaking users do live in Russia though...

Do you guys understand that "bound by our privacy policy" cannot be translated into Russian properly, no matter how hard you try and how nicely it looks?

Unless you provide us with a proactive method of disabling any access by any SUP to our accounts, you'll see two things:

(1) massive exodus of folks
(2) legal action in the US, potentially class action

I know several folks, who are prepared to lodge complaints with the FCC and other regulatory authorities in the US unless you *immediately* block any SUP access to any of our private data, and do not give SUP any such access *until* you provide us with a button/checkbox/form saying "no, I'm not to fall unto SUP, never, ever, ever".

It should NOT be opt-out, it should be OPT-IN for SUP. Please consider this as my official legal notice to such effect.

i would love to see the licensing agreement. PR stuff is nice, but the actual wording of the contract would make more sense. Six Apart is abusing the fact that they are a private company, but there must be a loophole for a lawsuit if anything goes wrong.
