BREAKING---KERRY TO UNCONCEDE IF THERE IS EVIDENCE OF FRAUD
FORWARD TO EVERYONE YOU KNOW
EMAIL FROM DC LAWYER CYNTHIA BUTLER

I am angry and getting emails and recrimination from people wondering
why KERRY just caved and is not fighting this before the final count in
Ohio, before any of the fraud was challenged, before New Mexico and Iowa even
came in.

There is widespread feeling that he did not lose the election and that
it was taken from him.

There is enough here to warrant investigation and enough to challenge
the results. It's coming from all corners.

I understand that he has until the official count certification in Ohio
to Un Concede which is several days from now.

Anyone who thinks that he should unconcede should give reasons why -
whatever they noticed, particularly in Red Republican Governed States
using electronic machines- and send them directly to Cameron KERRY, John
Kerry's brother at his law firm at the address CKerry@Mintz.com

They should inform us if they were not allowed to vote provisionally
(for whatever reason- they lost forms, ran out of forms, etc.) I personally
witnessed a number of things as I reported in Texas with the DCCC.
(Democratic Congressional Campaign Committee)

If you know anyone in particular in Ohio who tried to vote and was
turned away at the polls please get their information and notify the campaign.

They should be notified if they experienced lines longer than four
hours -particularly elderly or infirm people (we call that torture when they
do it to political prisoners) . They should be notified if people were told as
has been reported that due to too many people showing up in African
American precincts, particularly in Ohio where there were too few booths (some
only had two or three for the entire precinct) and told because of heavy turn out they could vote on Wednesday. If the numbers of these sorts of incidents
creates a percentage margin that exceeds the margin of victory- Un Concession has to be made to challenge the count.

If people wanted to and tried to vote and were prevented or actively
discouraged from doing so, that is a Civil Rights matter and must be
dealt with in terms of the ultimate count.

This is the last email that I am writing on this subject in this venue.
I am taking it up in other venues.

Please pass along this to your listservs so that we may make Democracy
Work in America. We are not a country where he who cheats best wins.

What's with your headline? There's nothing to indicate that Kerry really would "unconcede" if frauid is found. I'd love it if he would, but still I haven't heard or read any indication that he would do so.

i was under the impression that he wouldn't have to "unconcede"...if it is found that he actually got more votes, the presidency would rightfully go to him, regardless of his concession. but correct me if I'm wrong....there's too much wrong information goin round these days.

Hi Friends. This is Cynthia Butler. I wrote that piece. I had no idea it would end up on a website; I sent it to a few friends then a few strangers started emailing me telling me it was on the web. I am a real attorney in Washington, and only cheesy on occassional saturdays. There is massive fraud in Ohio and we hope to get to the root of it and appreciate all the help we can get. It's really me again; For the Record, whatever list someone thinks that they have telling them I am diverting energies is whacked.
There is not a more committed Kerry supporter in America. I worked volunteer on his campaign, I worked volunteer for the DCCC. I worked previously for Clinton-Gore in 1992 and served on that Transition Team. My Democratic loyalties credentials and work are unquestionably solid.
The effort to challenge the Ohio count and make the Fraud issue potentially challenge the integrity of the process is also being done with other committed Kerry volunteers who may be emailed directly as well such as Bob@Democrats.Com, or Steven Leser the person who organized all Yahoo bulletin boards for Kerry during the campaign, at Stevenleser@walla.com

I dont mean to be the party pooper here, but a time has to come when we accept George Bush as our president. There is nobody who would want to see John Kerry president more than me, but a time has to come when you have to face reality. Dont get your hopes up too high, if something is going to happen it will, but I doubt it.

I'm sure many people feel like this, and I'm empathetic. Who wants another fight. However...there are important issues here, in particular the integrity of our election system, which is the only way that people in this country have access to direct democracy. The issue here is determining what the reality is. If you assume that the election was fair and Bush won, then I can see how this feels like a diversion of energy. The fact is, we don't really know whether the election was fair or not, or whether Bush won or not, and there seem to be indications that it may not have been or he may not have won. In addition there is a clear appearance of an issue, since an extremely strong supporter of Bush controlled a large number of election machines. And remember, if "something is going to happen..." it will be real people like us that make it happen. It will not "happen" by itself.

We write with an urgent request that the Government Accountability
Office immediately undertake an investigation of the efficacy of voting
machines and new technologies used in the 2004 election, how election
officials responded to difficulties they encountered and what we can do
in the future to improve our election systems and administration.

In particular, we are extremely troubled by the following reports, which
we would also request that you review and evaluate for us:

In Columbus, Ohio, an electronic voting system gave President Bush
nearly 4,000 extra votes. "Machine Error Gives Bush Extra Ohio Votes,"
Associated Press, November 5.

An electronic tally of a South Florida gambling ballot initiative failed
to record thousands of votes. "South Florida OKs Slot Machines
Proposal," Id.

In one North Carolina county, more than 4,500 votes were lost because
officials mistakenly believed a computer that stored ballots could hold
more data that it did. "Machine Error Gives Bush Extra Ohio Votes," Id.

In San Francisco, a glitch occurred with voting machines software that
resulted in some votes being left uncounted. Id.

In Florida, there was a substantial drop off in Democratic votes in
proportion to voter registration in counties utilizing optical scan
machines that was apparently not present in counties using other

The House Judiciary Committee Democratic staff has received numerous
reports from Youngstown, Ohio that voters who attempted to cast a vote
for John Kerry on electronic voting machines saw that their votes were
instead recorded as votes for George W. Bush. In South Florida,
Congressman Wexler's staff received numerous reports from voters in Palm
Beach, Broward and Dade Counties that they attempted to select John
Kerry but George Bush appeared on the screen. CNN has reported that a
dozen voters in six states, particularly Democrats in Florida, reported
similar problems. This was among over one thousand such problems
reported. "Touchscreen Voting Problems Reported," Associated Press,
November 5.

Excessively long lines were a frequent problem throughout the nation in
Democratic precincts, particularly in Florida and Ohio. In one Ohio
voting precinct serving students from Kenyon College, some voters were

Highlighted areas represent 90% (very, VERY unlikely) and higher (up
to 1160.78%) voter TURN-OUT! 29 are above 100% Calculated from data
on county page --(Ballots Cast/Registered Voters) *100 = % turn out.
Ballots Cast SHOULD NEVER be more than Registered, thus per cent
should NEVER be higher than 100% This amounts to 93,136 EXTRA votes
beyond 100% in those precincts! This is just for ONE county!"

The Fraud issue is being tracked in Foreign Press better than here where there appears more of a press black out, where we have had reports of even reporter intimidation and discouragement of reporting on fraud and voter suppression issues. The Guardian Newspaper in the UK is more on top of it than most major networks here, save CNN.

First of all, did Bush win? The overwhelming majority of Bush's winning margin in Ohio (85.6%) came from just nine counties (Auglaize, Hancock, Holmes, Mercer, Putnam, Shelby, Union, Van Wert and Warren) where he got over 70% of the vote after breaking that threshold in just two of them in 2000. Warren County, the only one of Ohio's 88 counties that closed its vote counting to the press and the public on the advice of the Federal Department of Homeland Security, has some interesting peculiarities. According to CNN's exit polls, Kerry won 51-48 among people in Ohio in families earning less than $100,000/year. The median income in Warren County is $57,952 and according to the Census fully 81% of households earn less than $100,000/year, and yet Bush won Warren County by a better than two to one margin. And although Democratic voter registration increased by 50% from 2000 to 2004 and Republican registration declined 3%, Kerry got almost the identical share of the vote Gore got !
(28%) while Bush's share increased two points. Foreign reporters are also investigating oddities in Florida as well because the U.S. press corps and the White House don't want to admit to the possibility that there is a pattern among the counties that reported election difficulties. Please call and e-mail political reporters and ask them to take up this inquiry.

Second, we're asking everyone in the DC area to come to LaFayette Park in front of the White House on THURSDAY at noon to protest the massacre in Fallujah. See IraqalypseNow.com for more details. Bring noisemakers and friends. Here is what we need to make this a success: Come to a meeting Tuesday 11/9 at Spy Lounge in Adams Morgan if you will help us organize this. In particular we need people willing to hold up signs on the bridges on Wednesday morning and leaflet at metro stops to turn out a crowd of 1,000 people. And we need a few "marshalls" on site on Thursday. Our goal is to get people to face the truth about Iraq and about the huge deception of World War I and every war since then -- that one more war will bring peace. Electronic voting Scams, flimflams and hacking jams

Serious questions are being raised about the use of electronic voting machines in the 2004 presidential election. In an Ohio county, Bush mistakenly received some 3,900 extra votes. We speak Johns Hopkins University professor Aviel Rubin and investigative reporter Bev Harris.President Bush arrives back in Washington today after spending a 3-day weekend at Camp David. Since John Kerry conceded to Bush last Wednesday, the president and his advisers have talked extensively about what they call Bush's strong mandate to govern following the November 2 election. But as the rumor mill swirls about a reshuffling of Bush's cabinet and John Kerry returns to the Senate, there are many people who are not willing to simply move on from last Tuesday's election.
Many of John Kerry's supporters were stunned last Wednesday when their candidate conceded the presidency to Bush. Just hours earlier, his running mate John Edwards told a rally of their supporters in Boston that they would not stop until every vote was counted, a reference to the hundreds of thousands of provisional ballots in the key state of Ohio that some Democrats believed could have tipped the balance. But it's not just the provisional ballots.
[...] In a voting precinct in Ohio's Franklin County, records show that 638 people cast ballots. Yet, George W Bush got 4,258 votes to John Kerry's 260. In reality, Bush only received 365 votes. That means Bush got nearly 3,900 extra votes. And that's just in one small precinct. This in a state that Bush officially won by only 136,000 votes. Michael Howard deepened his feud with the White House yesterday when he pointedly refused to offer the traditional post-election congratulations to George Bush.
Angered by a White House edict banning him from meeting the president - as punishment for criticising Tony Blair over Iraq - Mr Howard said it would be wrong for him to express any view on the poll.

In an interview with the Sunday Telegraph the arch-Atlanticist was asked whether he was pleased that a fellow rightwinger had beaten a liberal. He said: "I made it clear that I could work perfectly well with both President Bush and President Kerry ... I don't think it's appropriate to express a view on those elections."

Mr Howard's remarks may appear bland. But in the language of diplomacy they amount to a rebuke to Mr Bush - and in particular to his polling guru, Karl Rove, who told him he would not be welcome at the White House after he criticised Mr Blair's use of intelligence before the Iraq war.

Mr Rove was reported by the Sun as telling Howard aides: "You can forget about him meeting the president. Don't bother coming."

In his interview Mr Howard hit back at Mr Rove, who is widely credited with masterminding President Bush's decisive victory. Criticising the White House for being "very protective" of Mr Blair, he added: "I am not going to be told by anyone how to do my job and if it displeases those in the White House, that's tough."

Mr Howard's decision to distance himself from the White House reflects his belief that Mr Bush is so unpopular in Britain that voters will be impressed by a politician who stands up to him. This has created a unprecedented situation in which a Labour prime minister will be feted at the White House while a Tory leader is cold-shouldered.

We are aware for example that people were told that they could not vote provisionally for reasons cited above, that they were told they could vote on Wednesday, that they were directed to wrong precincts in many parts of the country,in some cases because the Republican county clerk provided wrong polling location lists to the local papers in African American communities. There are a number of clever suppression tactics that we want to document. It has been variously reported that as high as 40 percent of all registered voters in some places did not vote or their vote has not been counted. We want that figure analyzed precisely to see WHY people's votes either are not counted or they did not vote. The WHY may be the Key to Victory.

From Steve Spitz; Washington, DC Attorney and Election Protection Attorney on Election Day

The election protection folks at the Lawyers' Committee and People for the American Way had people fill out incident reports based on the hotline calls. I believe I filled out a couple from Ohio and Florida. (This was the Sunday before election day - people had not received absentee ballots, voter reg. cards, etc.). One of the lawyers at the Lawyers Committee working on the project is Jonah Goldman - e-mail jgoldman@lawyerscomm.org. This is a non-partisan project. I worked in VA on election protection on election day for the Kerry campaign.
