Lady Sovereign's New Album!!

Power Hits 103.3 FM: Legal Pirate Radio?
I still get google alerts for "Pirate Radio" (and for KBFR) despite not being juiced in to it for well over a year now. Most of the alerts are articles about the Pirate Radio scene in London (which is massive) with the occasional story about a Pirate Radio station in the United States along the lines of "Pirate Radio station in city X gets shutdown after FCC visit.. blah.. blah.. blah." BUT THIS IS DIFFERENT... Yesterday I got an alert from an article appearing in Quad Cities Online about Power Hits 103.3 FM. It's interesting because these Pirates, who are making no attempt to remain anonymous, are citing a federal regulation "granting an emergency broadcast on a temporary basis in extraordinary circumstances, such as when the United States is at war." It seems like they're looking for a legal battle -- which would be an interesting one. I hope it works out for them, but I know the FCC isn't stupid and will try to find a way to ruin their "make the FCC look evil and Pirate Radio look good in court" plans. Unfortunately, they don't cite the specific federal regulation that gives them this authority in any of the articles on the about the radio station. I searched the Code of Federal Regulations as near as I can tell they're talking about title 47 part 73 section 3542 of the Code of Federal Regulations. Authority may be granted, on a temporary basis, in extraordinary circumstances requiring emergency operation to serve the public interest. such situations include: emergencies involving danger to life and property; a national emergency proclaimed by the President or the Congress of the U.S.A and; the continuance of any war in which the United States is engaged, and where such action is necessary for the national defense or security or otherwise in furtherance of the war effort. However, if you read the text it does say that an informal application may be used, among other things somewhat mitgating their argument. But, they still have pretty solid ground for stirring up a legal battle with the FCC that would bring the arguments in favor Pirate Radio and against media consolidation in to the main stream press. I really do hope they succeed.
