Looks like Meyshi decided to DCMA me as well.
Time to play.

EDIT: Does anyone but me cry BS that her cousin died...? I know that when one of my friends died in HS, I certainly wouldn't have been in good enough spirits to PS just cuz I wanted to PS for teh lulz.

To Whom It May Concern,

At 13:33 UT, August 11th of 2007, I was sent a notification from LJ Abuse, stating that a DCMA claim had been filed against me for post http://mcpo-john117.livejournal.com/187033.html , stating that I had violated the copyright of another.

This is a counter-notification, informing LJ staff, and the claimant in question, that I have not violated any existing US Copyright Laws, nor does the claimant in question have any right to claim ownership of a work of fanfiction. My usage of the Fanfic-writer's work was well-within the bounds of the Fair Use Doctrine, which covers not only reviews, but satirical parody as well. The entire piece was not quoted, several parts were cut - as is stated in the work of satire itself.

However, even if I had quoted the entire piece, the Fair Use Doctrine places no legal limitation on the word count that may be quoted. So long as I have not laid claim to the piece as my own, and the author is not only credited for her original work in the header of the journal entry, but linked to as well, I am well within the bounds of the law.

Furthermore, the piece in question is a work of fanfiction. Meaning that unless the claimant is JK Rowling herself, the claimant has no right to file against me.

This individual has been trolling the LiveJournal community Deleterius, located http://community.livejournal.com/deleterius, for some time now. She and her syncophants have been rather abusive and have threatened outright violence against the userbase there, for daring to exercise our right to satire under the Fair Use Doctrine.

Oh, I don't think it's a vendetta, actually.
I think she's applying adolescent logic here - it worked once, so it'll work again. She thinks people are afraid of her.
She's 16 years old, so her parents will have to be the ones who actively pursue the lawsuit. It will be interesting to me, to see what she does when someone actually stands up to her and says, "Kid, stfu and sit back down."

It's fanfiction! We have free range! Because it's free range or nothing at all because we'd all get sued for copyright infringement. Every single one of us.

... okay, maybe I do, but I do have to say that personally I find it really convenient her cousin died just as her little vendetta boat started sinking. "Oh noes! Those Deleterius skanks are being mean to me and my cousin just dieded! Oh woes!1!11!"
It's awful to lose a family member. It's inappropriate to either a) try to use that loss to gain sympathy/support in other completely unrelated areas of your life or b) fabricate a loss as a way to take some heat off yourself while you circle your wagons (or try to patch the hole in the SS Vendetta).

Her over all attitude isn't befitting someone who apparently just lost a family member that they were close to. She spends more time lamenting us than the death, then adds a wiseass little "Teehee I'm cute!!!" PS at the end.

If someone I care about dies the last thing I be interested in would be to run around and file complaints however justified I might feel in my own little world to make them. I'd be depressed, cry, draw doodles and try to spend some time with my friends or family (if I had any that I liked enough to spend time with)

Things that scare me about Meyshi:

1. She's a year older than my little sister and has a kid.
2. She has reproduced.
3. She wants to teach Jewish studies (back away from my religion, bitch).
4. She STABBED SOMEONE. Dude, that's extreme, even if she did stab you first. She goes to jail, you don't. Come on.

Things that don't scare me:

1. Her "lawsuit." You picked the wrong fandom to try and sue someone over copyright infringment. Bring. It. On.

Hmm... I'm not sure if I believe that her cousin just died, either. Or that she has a kid. Or that she knifed someone. Were the latter two in her profile before, or were they just added? If all that stuff is true, too bad. (Except for the knifing someone bit, and the apparent desire to do so again... that, if true, is just plain disturbing.) However I agree, the "PS - hehehe" at the end just screams "haha, now you feel bad for me you fools!"

And then there's this: "I just don’t like all the damn attention I’m getting over this." Sooo... you file claims against everybody, causing an even bigger kerfluffle. But you don't want any attention! Right. Not too bright, this one.

Well, OBVIOUSLY everything she says must be the truth and all her legal claims are justified! The US Constitution specifically protects Meyshi from harm, you know? Just her. Nobody else.

See, Harry Potter belongs to her now, because she invented "Tee," who Rowling "should've included because we need diversity."

Stranger things have happened, I guess, I'm just not inclined to take her word without a backup source on any of the stuff in her profile (aside from the "I am obsessed with my fan-insert who has no business being there", that, I believe.)

Best of luck to you! I can understand where she might be coming from (sort of. Before I found Anti-Shur'tugal and realized that plagarism was plagarism), but she's gone too far. Attacking a community simply because they criticized her works is ABSURD - even Anne Rice only posted a massive rant of amazon.com (and her husband DID die, and she WAS going through a born-again stage), so y'know, it would be like Laurell K. Hamilton attack the lkh_lashouts community for daring to mock her work. *sigh*

Meyshi NEEDS TO LEARN that just because she does a total AU DOESN'T CHANGE THAT SHE TOOK THE NAMES FROM HARRY POTTER AND CLAIMS IT TO BE FANFICTION OFF OF HARRY POTTER. If she changed the names... maybe she'd have some grounds to attack. But as is, she's not-for-profit using someone else's works, and J.K. Rowling's copyright hasn't expired yet. So. She's in the same boat as we are.

I can even understand Teegan. Look, from her profile picture, she may be of his ethnicity. So, when she says that Harry Potter needed "more diverse characters", I think she was complaining about the lack of black people in Harry Potter. Yeeeees, there was Dean Thomas, but he's a) not a main character and b) it's not hammered into your head that he's black, like it's hammered into your head that Ron has freckles and red hair *drools* *snaps out of it*. So, she might not even have noticed that. Now, in compensation, she might have decided to stick in her own character and overpowered him to avenge the lack of characters previously like him.

Goodness knows, I did that with MY main OCs during my (pre-internet) fanfiction days. I didn't even realize that was what was going on, but... suffice to say I had a similar problem with the lack of non-comic-relief smart characters... and so ALL of my main OCs had freaking ENORMOUS IQs. I mean, they godmoded their way across the landscape solely on the strength of their IQs (in some cases. In others, they godmoded their way through on the basis of OTHER special abilites... I swear I always kept in-canon as to the strength and type of said abilities...), which was, in retrospect, BLATANT wish-fulfillment. And yes, these OCs (at least the MAIN-main ones) would (with the exception of one in a sub-section of one fanfiction world) invariably be male, despite MY being female. Why? Weeeeell... because girls were always boring compared to the boys (except in some story arcs in certain series), and they were NEVER the geeks, and they didn't DO anything special compared to the boys. So, the SPESHUL OCs always had to be male, because that was where all the coolness was at. *cringes in embarassment* And they frequently (75% of them) had slash-type leanings in AUs-within-the-AUs (though in the main AUs/fanfiction universes, they had steady girlfriends), because even before I knew of the concept of shonen-ai or slash, I reinvented it. *rolls eyes* Ja. Very weird.

But this fits the pattern of Meyshi's character quite well, don'tcha think? The only reason I kicked the habit is because I have a certain innate addiction to satire, and so I saw MANY, MANY Sue-and-Stu-type characters being mocked online, and saw the habit of people in fanfiction and out to write POV pieces from all the characters... and so, eventually, one night when I was absolutely ticked off at the world, I wrote a piece from a Sidekick!Stu's POV regarding the main Stu-and-Sue characters of his universe... and he smashed them. And verily, afterwards, I realized they WERE immature brats with delusions of grandeur... only after I went on a two-month rampage where he got characterized as either a psycho who wanted to kill them out of envy, or a whiny guy who angsted because the Sue loved the Stu (WHO WAS ALSO HER BROTHER!!!!) more - mostly both. Yes, you saw the "brother" part correctly. Let's just say that, when the Sues and Stus get TOO overpowered, they are forced to mate with each other. ...And now the whistleblowing Sidekick!Stu is my favorite sporking assistant! *claps Richard on back*

... Notice the two months?

Awww, Richie, I'm sowwie! Anyway, point being, Meyshi MIGHT reform even after all of this.

But don't hold your breath. Or even lessen your food intake. We're not her precious Stus, even the Sidekick versions, so she won't listen to us.

And one more thing? If I had ever PUBLISHED on fanfiction.net or anywhere else the fanfiction involving the Genius!Stus, and someone had criticized them, I would have said (to myself, at least) that they were just JEALOUS of the high IQs of the Stus. *rolls eyes* Yeah. But in summary:

I THINK I understand where Meyshi's coming from. I ALSO understand that she needs to reform.

Her reasoning aside, and your sympathies and attempts to explain aside...
No offense, but age, stage, whatever - nothing excuses the fact that this girl thinks she can throw her weight around by committing an offense that equates to a felony under US Law, against a US Citizen.
She's going to get her comeuppance, and she will either learn her ways, or her mommy and daddy will be paying a lot of court fees.

COUNTERATTACK. KILL (in an Internet sense). She really does deserve whatever she gets. It's no longer an issue of a Suethor rabidly defending her self-insert, it's now a matter of a full-out Fandom Wank type issue, complete with lawsuits. Bring out the big guns, I say. >:( We're all with you.

The longer this goes on, the more like a real battle it's beginning to seem.

I'm getting a mental image of a lone Suethor astride a unicorn, bedecked in a pink princess dress and mood-ring hair....then as the sun rises over the crest of a nearby hill, the shadows of the opposition appear; dozens upon dozens of warriors, fighting for Fair Use of satire and for the preservation of canon. In their hands each clutches an oversized piece of flatware, gleaming silver as they catch the light. The Deletrians raise their sporks and charge into battle!

...If I was any good at using flash I think I'd make that scene just to commemorate the event. ^_^
