Law Enforcers are Law Breakers in California

(Note from moderator - this is being reposted, with updates... the dog has continued to bark all this time.)

Our neighbor on the right side, the guy has a dog, named Storm. He is a big dog. Very violent. Barks at very high volume. The dog used to work as police dog. Retired because it had some protein digestion problem. Has too much energy. It has been barking bad for the past three years. We have done everything. I know we have put up with this for too long. The guy works for police, his wife is a lawyer - we know this because he threatened my husband: "Do you know what my wife does? She is an attorney!"

Anyway, the new situation is, during the crazy wind last week, the guy's fence fell down. So starting this week he kept the dogs in his small fenced side patio, which is right underneath our master bedroom window. I am on maternity leave, so I am at home everyday with one month old baby.

The dogs are bored. Storm barked all morning, about two hours nonstop, the day before yesterday. We left a short note on a post-it, on their door, asking them to do something about it. They returned a printed letter in the noon, saying nothing can be done about it. Fence down, dogs had to kept inside the locked patio. They get bored, they bark. The shock collar we bought for them - we paid $80 for that collar, Storm has got used to the collar. So in the evening, my husband dropped by their house. His wife answered. My husband said this is a serious matter, they cannot just leave it barking like that. The whole conversation was polite and short, less than 2 minutes. His wife said she understood, but not much can be done. Blah blah.My husband came home. A couple minutes later, the guy came and pounded on our door. When my husband answered, he said in an angry tone, that "How are you? ..I would appreciate it if you did not harass my wife!" And blah blah blah. "..I got your note...I returned your note..."

His wife told him to go back home, holding their daughter, standing outside their door. The guy didn't listen. Then his wife came over and dragged him home.
The next day they kept the dogs inside the garage.

Today they let the dogs out again. And Storm has been barking from 10:59 AM nonstop to now, which is 2:17PM. We ran out of one videotape.

I called HOA. She said all they can do is send a letter. If more than one complaint, maybe go further. The other house is empty. The next house, I talked to the owner back in Sept. He is bothered too. He said he talked to the owner last year too.
Animal control sent one officer over when last time I called, which is about 2 years ago. The officer said "dogs will be dogs" to me in the callback later. I think the guy works for police, they somehow bonded. Still I called animal control again today. They will send one officer out again. But since last time was more than 6 months ago. So this will be treated as a new claim.

I am ready to take this to court. But since the guy's wife is attorney, I need one good attorney. Does anyone have any recommendation/suggestions?

I am extraordinarily disturbed in hearing that yet another cop is doing the lawbreaking here. A few posts below, we have another victim who is dealing with a former cop. I personally am dealing with a cop neighbor with a barking dog as well.

I find this so appalling! First of all, police are civil servants, and should be SETTING the example in their community and neighborhoods, not causing the problems. Second, they know that these laws are literally unenforceable in most places, and are using that knowledge and perceived power to behave badly.

Inexcusible! I'm starting to think that law enforcement officers are the core of the entire problem... even more so than the irresponsible dog owners. And the attorney wife being an active participant as well... and using that job title as a threat, it's simply inexcusible also.

One thing you might want to do is research the wife... google her, check the state bar info, find out what kind of law she practices and how much of a threat she really is... odds are she would need an attorney of her own should you go to court.

I hope you go after them in court and win in a huge way... I personally can't wait to applaud your victory!! Go for it, and good luck!!!!

My neighbor has one of those 'failed' police German shepherds, and it thinks it's still working.

I’ve been noticing the same thing. What kind of hiring standards do police departments have these days, to end up with riffraff like these?

And to top it off, abusing a supposed ex police dog like that! Those dogs tend to be, for department liability reasons if nothing else, very well trained and controllable. I wonder how a judge would react to a department head knowingly placing an ex police dog with someone so blatantly incompetent that the dog degenerates into a ‘very violent’, barking menace. What if the unexercised, under stimulated, improperly socialized, abused thing had been dumped outside when the owner’s fence blew down, ran away, and mauled someone? Now wouldn’t that have looked good in the papers; ex police dog mauls child! Next to an article about how police dogs are explicitly selected and bred for a strong, unrelenting bite, and should at all times be accompanied by a competent handler.

I guess a department who hires thrash like your neighbor eventually end up having nothing but garbage available when time comes to fill their department head position, too.

This whole situation sounds so f’d up I would definitely check up on this guy’s background. Maybe he’s really just some minimum wage mall ninja; or that ‘worked for the police’ means he used to pump their gas back in high school, before dropping out to pursue huffing the stuff full time. Plenty of barely literate security guards and such like to pass themselves off as ‘cops’. The same goes for office assistants in legal offices as lawyers. And to lowbrows like that, I can only imagine passing their cheap, backyard bred thrash dog off as an ‘ex police dog’ make them sound all kinds of mean, tough and important.

May be you can try a new product called Cool-Dog spray. It is very effective and friendly for dog obedience training and to control dog barking problem. Because it is new, it is available on line and not easy to find in the store yet. You can try their website www.cool-dog.us to get it.

I went to the Cool-Dog web site. It provided little or no information as to what the product is (what its ingredients are), how it is used (in a spray bottle?), or WHO uses it (does it have to be only the owner - or can a neighbor who's disturbed by the dogs' barking use it?). Since the web site provides such sparse information, perhaps you can enlighten us. WHY do you endorse it? If it's a good product, let us in on the secret. Give us a HINT.

I saw your post from last january and looked at the cool-dog.us website. All I saw was that the dog spray was supposed to be safe and natural. So….I emailed the company for information and they sent me some blurb about dogs are sensitive certain smells. I admit I’m cheap, paranoid about everything, and desperate! So, I bit the bullet and ordered a small size. Just got my dog spray yesterday and tried it on my dog….My kids have a 4 year old white terrier they call Mobe (maybe for the white whale) that will not stop barking when kids are playing across the street or coming home from school. To make a long story short….when Mobe started to bark, I sprayed him 2Xs to make sure he smelled the spray. The bottle said to spray your dog from about 1 foot away. Mobe stopped barking, put his head down and walked away. About 3 hours later, someone knocked on my door and Mobe started barking again. I sprayed him 1X….same response. He probably recognized the smell. Not toooo bad! FYI - This is what it says on the label, it has some food flavors, vinegar, citric acid, and water. GOOD LUCK! Rick

It is a nonsense. How can you put up with this. You should move out of this neighborhood, slap a law suit in their noses, asking for money compensation, blah blah, blah... It is that simple. Tape the dog intermitent barking (with a camera with good microphone), label the movie with the internal camera dates and hours, it will be very useful at the court. Also, ask the children doctor who takes care about the baby for an exame, and the effects of sleep deprivation to her health. I guess that would shut that sob up. I personally would not accept that if my wife and baby were inflicted to this nonsense. Good luck.

We solved our barking dogs problem. We sold the home with the barking dog problem and bought a nice place in the country, with 700' of frontage. I can occasionly hear a dog bark, way off in the distance. We put up with barking dogs for years, rented a mobile home to get away from them, rented apartments, and paid double for years. We likely lost money on the home sale, but we shouldn't have to put up with barking dogs again, if our luck holds. It took about 6 years to sell that home, most of the time we could not live in the home because of barking dogs. The people who bought our home have a dog/dogs, with the neighbor having dogs also, they all should be in dog heaven. My experience, over the years, dealing with several dog problems, is that this is the only solution, that is, to sell, and move. No one is really looking for a solution, even opposed to any type of solution, wanting to try to settle the millions of barking dog problem cases, one dog at a time, across the Nation and across the World. I would suggest that many simply lack intelligence, and may have some serious mental health problems. To say the least, about those trying to solve the problem, they are a bit naive about alot of things, and about people in general. They may lack life experiences, had it too easy, always dealing with reasonable, well adjusted people, not knowing the true morons, and maladjusteds, that there are out there. Best of luck to those still having serious barking dog problems, my heart goes out to you. Take care of your health, and I wish you the best. Sue the living daylights out of them, if you can.

Yes, this is the only and fastest solution as you said in your posting. I´m sorry going against this site and his agenda of touching the hearts of the authorities for the barking problem. THey are not there for it, they have a greddy agenda only, to get rich stealing peoples hard paid taxes. It is naive to think this problem will have a solution sooner or later, it won´t. People will get the dogs and if they bother others, the better. Nothing like hammering the nerves of a neighbor so to cause him illness and a premature death. The modern society is a cinical one, those that paint a pink world are true allienated people, searching for mercy and kindness in human heart. There is no such thing. Madre Theresa is dead! My neighbor continues his provocative agenda of starting his dog to bark during hours at night, the amount of energy he devotes to this is alarming, instead of cleaning the place that is drowned in feces of dogs. It is just plain nonsense the way people behaves knowing that they are inflicting pain in another human being. I already gave up society altogheter and wish sincerelly the the cleansing comes from the sky.

People are more important than dogs

If nothing can be done about a particular dog's barking then the dog needs to be euthanized. People should not have to suffer, lose their peace, health, or property over an animal.

If these people can't or won't control their dog the dog should be confiscated and either rehomed or euthanized. It is amazing that people are allowed to ruin their communities and neglect their dogs without restraint or consequences. Using a dog as a weapon to harm your neighbors should get you sent to prison, fined, and barred from animal ownership.

Unfortunately, many people have unrealistic expectations - believing that all dogs will be able to find caring and responsible owners or that bad owners can all be reasoned with and reformed into good dog owners. The truth is that there are much more dogs needing homes than there are good homes for the dogs. The best thing for the dogs would be extremely strict requirements on dog owners. Dog ownership should be strongly discouraged as most people do not have lifestyles and mentalities conducive to responsible dog ownership. Those that shield neglectful dog owners and advocate that everyone should own a dog or several dogs are not dog lovers. It is like advocating pedophiles and psychopaths adopt children because there are too many orphans. Some people should not have children be around children or be placed in any position of responsiblity or trust.

Another realistic and true to life (I´m reduntant I know) view of dog ownership. It is amazing how numb our society became over the centuries over the suffering of people. If you have a problem with a barking dog, then the wrong party in all this is the suffering soul that dare to speak up for his rights. The dog is a deity, untouchble and worshipable beyond any logical explanation. Our society is doomed to become so cinical to the point of having nice clinics for dogs, while human beings, less fortunate economically, literally will be dying in front of crowded public hospitals. Wait a minute, it is already so in Brazil!! Do you people know how they call a person who builds a luxurious pet clinic over here? An entrepeuner!!!! It is unbelievable how pathetic those people are.
