Lawyer Help (and a short story)

  • Jan. 30th, 2008 at 2:31 PM
My friend left her husband in TN about 2 years ago. They never legally seperated or filed for divorce. They have been amicably sharing custody of their daughter since. However since December it has become increasingly harder for my friend to get her husband to answer his phone or return her calls, and she has only been allowed to talk to her daughter a handful of times since December. Now it appears her husband has moved (the xmas presents returned in the mail) and he has switched jobs, all without notifying my friend. Her mother in law is also refusing to give any information.
I've read in this forum before about there being free legal advise/couseling through UT and was wondering if anybody could direct me there, or if anyone has come across this type of situation before, or knows a good referral in town that could help.
Also does anybody know how much an out of state divorce should cost, because my friend has been getting $5-6000 quotes and this seems slightly ridiculous.

Actually for a divorce involving custody those figures sound low. If it gets nasty it will be much higher. Keep in mind a lawyer is a working professional. An inexpensive lawyer will run $150/hr with most closer to the $250/hr range. Even at $6k that's only 24 hours of work on the case at $250/hr. If it gets nasty divorce's can easily go into the $10-15k range. That said, it being an out of state lawyer shouldn't make too much difference. Many lawyer will do free consultations but it sounds like she has taken advantage of them already if she is getting quotes. My only other advice would be that the figures she is getting are probably pretty close to what most lawyers will charge to get started. Lawyers aren't cheap for sure.

A friend of mine was trying to get a divorce in Austin and the $5-6k was on the low end (no custody or property involved).

Volunteer Legal Services runs free legal advice clinics-- see link.

Good luck to her.

I would check into glee's comment about the free clinic as 5-6K is on the low end. My divorce 6 years ago cost almost 8 and it was amicable at the time. Also, when you friend talks to lawyers, some will take a payment plan, although it depends on the lawyer.

Good luck to her, a mom without her kids like that is gut-wrenching to hear about.

ALSO--Your friend needs to start documenting as much as she can to help her case. Like when phone calls were made, what date those presents were mailed and when they were returned. And not to scare your friend or anything, but this is kidnapping, even though it's the child's father--he has taken the child without consent of the other parent--even though their agreement was verbal.

Get your friend a notebook and tell her to start writing as much as she can with dates/times/locations and even what their verbal agreement involved.

The free legal counseling at UT is for students, but their law school sometimes has clinics where people can come for information.
