Goodbye?
Joshua Boyd of EarlmredNET (Matt's buddy and erstwhile host of howwasshe) seems to be pissed. The site shows a text image of Hitler, with what appears to be insults in German. I don't know German, and babelfish was only able to get a few words of it, something about Jews and pink triangles. I presume Josh is saying goodbye, trying to get an insult in? I don't know. Howwasshe is still down, and Matt hasn't responded to my questions concerning his intentions for it. So is it down for good?
Hey Matt, if you're reading this, have you taken your ball and gone home, or is this yet another downtime while you work on your next trick? Edited to add: If anyone's curious about Matt's current project, he's got a blog going. It's not associated with howwasshe, but is just Matt writing about current events from his right-wing/libertarian-ish point of view. If you feel like heading over to argue with him, he'll probably be delighted-- he's all about debate. Just so we're clear: I think it's great that Matt is expressing himself in a legal way on his blog (that's why I'm giving him free publicity, since there aren't a lot of comments yet on his entries). I disagree with his point of view on a lot of issues, but that's fine. I say this because it seems like his personal site, schiros(dot)net, has been taken down. I didn't make any complaints about it, because it didn't show photos of underage girls in sexual situations, after encouraging users to submit those photos without the subjects' consent. I noticed today that both howwassheCOM and earlmredNET are down (no "we exceeded bandwidth" explanation or anything). I'm thinking two possibilities: 1) They gave up, took their ball, and went home, or 2) They're working on finding a new hosting plan. The site is still down, but I understand that Matt's working on a way to bring it back up. Meanwhile, I heard a rumor that friends-only posts from here have been showing up on his forums. I might do a bit more housekeeping here, when I have had a chance to check that out. I'll let ya'll know when I think the friends-only posts here are really friends-only. But this thought occurred to me, and I wanted to share. I heard a rumor that Matt was thinking of going to law school. No surprise, in this economy, everyone's trying to figure some way to make a bit more income. The thing about a legal career, though, is that you have to pass the bar. Yes, that's mostly a big written exam, but in most states (all states?) there's a "fitness" portion unrelated to any written test. If you have bad credit, or a drunk driving conviction, or were caught smoking pot, mental illness-- those are all problems that can come up. I know we've been advised to keep our noses clean, and that if we have anything on our records (even if we think our records have been expunged), to come clean about it and offer a good explanation on how we've reformed. The key is that the state bar has access to all kinds of records, including criminal investigations. Now, Matt, before you get upset about libel, nothing any of us may have said to any law enforcement folks will be an issue. It's all hearsay and inconclusive. However, if someone tipped off law enforcement to your site, and further investigation by experts looking at your site led the authorities to draw any conclusions or bring charges, that could go on your record. So as one law student to a potential law student-- you may want to do a bit of research before you choose where you want to practice. Pick a state that won't consider the ethics of your website in granting you admission to the bar. Law school is a big investment, and you don't want to waste it. This isn't any kind of threat-- you already know that your site has been brought to the attention of several law enforcement agencies (and I actually haven't had anything to do with that-- it was done before I created this forum). Where they take it is up to them. We may actually have helped you out a bit, by causing the site to go down so often, impeding any investigation. But you're working to fix that problem, right? In order for him to read replies to a comment he made to a friends only post, I've cut and pasted his note here. Matt-- I'm not going to delete your post. I will respond to it in more detail when I have time. If you want to remove the post below from this forum, let me know and I'll delete it. I think a discussion might be beneficial, though, especially concerning legal issues. I'll reply in detail later, as I said, because I want you to be aware of the law. Libel is not the main issue. **************************************** * Recent Postings I'm posting this in both the root thread and as a reply here, because I think they're relevant. Feel free to delete one of them if you think it's extraneous. My name is Matthew Schiros, and I'm the owner of HowWasShe.com. That sentence there is probably enough to get people to delete my post, but I would hope that cooler heads prevail. I'd like to start by saying that I'm sorry if people sympathetic to my cause have trolled your site. I do not support that, and I explicitly ask my users not to do so. In fact, I myself very rarely post to boards about the site, and when I do, they aren't in the tone that some of the posts attributed to me are. I'd like to address some of the concerns I've seen brought up here. First, in regards to the e-mail address issue... I'm lying. Straight up. That paragraph is there to get people to post. The email addresses are not actually provided to the users who post women. In some cases, email addresses are included in comments about women, but I generally try to delete those from posts. I also try to delete last names, etc... Every post that goes through the site has to be approved by myself or a member of my staff, and we're all pretty up on what we need to get rid of. Second, the issue that I somehow promote rape, wife beating, racism and lynching. Yes, it is true that I am the owner of amiblackornot.com, but I object to the claim that I am a "reknowned racist". Amiblackornot.com exists to provide people with a shocking, and yes, offensive, look at the issue of racial identity, to indeed ask the question "What makes someone black?". In these days of racial tension, most of it from the Left, it is important to know what we mean when we think "black person". At no point does amiblackornot.com advocate lynching and beating of black people. We do indeed have a guestbook, where we allow people to post pretty much whatever they want to. However, that exists as a place for individuals to say what they want to, in the spirit of the free flow of information that the Internet so readily provides. In regards to the posts on HowWasShe.com that advocate rape, woman beating, etc., those are CLEARLY jokes, and no one actually does them. What is not often mentioned is that most of the sexual diary is filled up with sexual positions involving midgets, or fecal matter, or some other absurd topic. Perhaps you think the jokes are in bad taste, but that does not mean that I advocate those things. On the issue of minors. Part of the user agreement of HowWasShe.com is that all pictures are of women over the age of 18. I have no possible way of verifying that the women posted are 18+, that is my users responsibility. When notified of the existance of a minor on my site, I delete her. I detest child pornography as much as the next person, and I will not knowingly contribute to it. Finally, in regards to potential law suits against me. The unfortunate thing for you is that I'm in the clear. I don't provide last names, addresses, phone numbers, etc, the girls are not clearly identifiable, and two of the standards of libel, maliciousness and falsehood, will be near impossible to prove in a court. I think it's sad to see that because I'm saying something you don't like, and the fact that it's about a group that you belong to, lead you to the solution of a lawsuit. However, what some of your members, and their friends, are doing IS libel. Some women have been sending letters to various organizations, falsely accusing me of a multitude of crimes that I simply have not committed. As these are organizations I wish to belong to in the future, it is considered libellous to make those claims against me. It would be an epic irony if the person to get sued for HowWasShe's existance is a dedicated feminist, wouldn't it? Additionally, I would ask that you take up any issues you have with me WITH ME. My telephone number is a matter of public record, as is my email. I no longer live in Cleveland, Ohio, and contacting my family there won't accomplish anything except perhaps a harassment charge. Been reading back through the several communities I read regularly, but there were posts about the site in various communities, so what I saw may have been a link from elsewhere. Oy, confusion. I believe he is at registerfly.com - abuse addy: risk@registerflysupport.com Here's my letter: www.howwasshe.com, a website hosted by Registerfly.com violates the terms of service below. The site contains obscene descriptions and depictions of women posted by anonymous men without the women's permission - including pictures (many obscene), pornographic descriptions, how-to descriptions of various forms of rape and sexual assault and other obscene material. The two most alarming aspects of this site are that women's personal contact information is given out so that other men may contact them anonymously via the site - and that MINORS are pictured and described in pornographic ways, with their names, ages, and high schools listed. These depictions violate laws in many states. and the Center for Missing and Exploited Children's Cybertip Hotline has been contacted to investigate the charges of child exploitation. Some of the women pictured on the site (including a professor at a University) are pursuing legal action against the site owner. After reading over your terms of service, I am sure you are not the type of company who wants to be implicated in these activities. Mr. Schiros, the site owner has been dumped from at least 4 other webhosts because of their legal concerns regarding the site. Please drop Mr. Schiros' account. Thank you for your consideration, M. Appropriate Community Behavior
I said most of this in a comment, but wanted to make sure everyone could see it, so here's a new post. I'm not going to kick people out of the community simply because they like the site. In fact, discussion is welcome. However, I request that people keep it on topic. I didn't start this community (just) because the site is offensive, sexist, or disturbing. I started this simply to provide a central place to update information about the current webhost or other companies associated with the site, and to possibly communicate with women who have been featured on the site. On topic discussion includes our experiences in trying to contact these parties, new information about subsequent webhosts Matt might use, the status of the site, etc. I think that it's also reasonable to use this forum to discuss the legal bases for civil and criminal liability to which the site has exposed Schiros. If someone believes that what Matt has done is legal, then discussion of your reasons for it are welcome. On topic matters include U.S. case law, statutes, Constitutional law, etc. If you just think the site is simply entertaining, personally non-offensive, etc.-- those feelings are valid, but not at all at issue here. That's off topic. What I'm saying is that I'm not going to exclude people who disagree with me from the community, but I will ask people to stay on topic. Someone mentioned this before. Now that we aren't getting a response from the webhost, let's rachet it up a notch and contact the CyberTip Line and report the site for sexual exploitation of minors at: Center for Missing and Exploited ChildrenBecause of the depiction and descriptions of minors in a sexual context, the site fits their parameters for sexual exploitation.
